To,
Members of Council,

Sub: Amendment to Circular No.08/2026-Customs dated 28.02.2026-Rationlization of documentation requirements under the Eligible Manufacturer Importer(EMI) Scheme-reg.

Dear member(s),

Wide Customs circular No.08/2026 dt.28th February 2026 & Notification no.12/2026 dt. 01st February 2026(copies enclosed), the Central Board of Indirect Taxes and Customs had notified the facility of deferred payment customs of import duty to Eligible manufacturer Importer(EMI).

The facility of deferred payment of Customs import duty shall be governed by the Deferred payment of Import Duty rules, 2016, as amended. It is expected that the extension of this facility to the Eligible Manufacturer Importers shall expedite the Customs clearance of their imported goods at the ports/Airports/ICDs. The facility shall be available to EMI till 31st March 2028 and it is expected that such approved EMI will be able to obtain AEO T2/T3 accreditations within such time which will enable to have assured facilitation and priority treatment and avail other benefits available to AEO T2/T3.           The existing benefits of AEO accredited entities will also be expanded.

Now, Central Board of Indirect Taxes and Customs has issued Customs Circular No.39/2026 dated 03.09.2026 regarding Amendment to earlier issued Circular No.08/2026-Customs dated 28.02.2026. This circular states the following:

In order to simply the process the Board has decided to revise the following requirements:

1.      There will be a reduced number of data elements to be submitted by the applicant in Appendix-I as against present requirements in terms of Customs circular No. 08/2026 dated 28.02.2026. These include non-submission of details pertaining to EXIM documents filed during the previous financial year, GSTIN status, declaration of manufacturing activity in FORM GST REG-01, GSTR-3B filing status, aggregate turnover and GST payment, date of commencement of business/GST registration, ITC-04 filing particulars, details of factory or manufacturing premises, property holding rights, book value of plant and machinery, major raw materials and finished goods along with HSN details, and particulars relating to job workers. This will ease the process of filing the application by the interested taxpayers intending to avail the benefit of the EMI scheme.

2.      The requirements for uploading certain documents as prescribed in Appendix-II has been dispensed with which includes copies of IEC, PAN, GST registration certificates, GSTR ITC-04 returns, GSTR-9C, audited financial statements for the preceding two financial years, and documents relating to ownership, lease or rental of the premises. The requirement for submission of the UDHYAM registration certificate, where MSME status is claimed; a Chartered Accountant’s Certificate bearing UDIN in the prescribed format; and an authorization letter for the authorised signatory shall continue. The number of documents to be uploaded has been reduced from ten documents to three documents in the revised application format.

3.      Appendix -III of the Custom circular No. 08/2026 dated 28.02.2026 has also been revised which required the Chartered Accountant to furnish reasons in cases where the applicant has negative net worth or negative net current assets.
This criterion has been provided in consultation with stake holders and in view of overall reduced requirement of furnishing documents at the time of filing application of EMI scheme.

Members are requested to kindly make note on the amendments to the circular and the required Appendix-I, II and III are attached for your reference.

Warm regards,
D. Gokulakrishnan
Deputy Director
