Sub : Reduction of reciprocal tariff of USA to 10%
Dear Member
You are aware that USA had earlier levied a reciprocal tariff of 50% on goods exported from India (25% reciprocal tariff and 25% additional reciprocal tariff citing Russian oil imports). This reciprocal duty for India is in addition to normal MFN duties applicable in USA.
Subsequently, India and USA launched the trade deal negotiations. As per joint statement issued by India and USA, it was stated that USA will reduce the reciprocal tariff for India from 50% to 18%. The date of effect of this reduction is yet to be notified.
Meanwhile, pursuant to the order of Hon’ble Supreme Court of USA, the Hon’ble President of USA has issued an Executive Order dated 20.2.26 (copy enclosed) terminating his various Executive Orders on reciprocal tariff.
However, as a temporary alternative to the reciprocal tariffs, the Hon’ble US President has issued a Proclamation dated 20.2.26 (copy enclosed) imposing a temporary 10% ad valorem import surcharge on global imports with effect from 24.2.26 and applicable for 150 days. The import surcharge has been imposed under Section 122 of the Trade Act of 1974 , stating to address the serious balance-of-payments deficits and its negative net international investment position.
The U.S. de minimis import exemption (Section 321) previously allowed goods with a retail value of US$ 800 or less to enter the country duty-free and with simplified, rapid customs clearance. However, this exemption was suspended for all countries vide Executive Order dated 30.7.25. The Hon’ble President of USA has also now an Executive Order dated 20.2.26 (copy enclosed) continuing the suspension of de minimus import duty exemptions.
In view of the above the leather, leather products and footwear exported from India to USA, will be subject to a reciprocal tariff of 10% with effect from 24.2.26. In addition, normal MFN duties (details enclosed) will also apply.

आप अवगत हैं कि संयुक्त राज्य अमेरिका ने भारत से निर्यातित वस्तुओं पर 50% का पारस्परिक शुल्क अधिरोपित किया था(25% पारस्परिक शुल्क तथा 25% अतिरिक्त पारस्परिक शुल्क, रूसी तेल आयात का उल्लेख करते हुए)। यह पारस्परिक शुल्क, अमेरिका में लागू सामान्य सर्वाधिक अनुकूल राष्ट्र शुल्कों के अतिरिक्त है।
इसके पश्चात भारत एवं संयुक्त राज्य अमेरिका के मध्य व्यापार समझौते के संबंध में वार्ताएं प्रारंभ की गईं। भारत एवं अमेरिका द्वारा जारी संयुक्त वक्तव्य के अनुसार, अमेरिका भारत के लिए पारस्परिक शुल्क को 50% से घटाकर 18% करेगा। तथापि, इस कमी की प्रभावी तिथि अभी अधिसूचित की जानी शेष है।
इस बीच, संयुक्त राज्य अमेरिका के माननीय सर्वोच्च न्यायालय के आदेश के अनुपालन में, संयुक्त राज्य अमेरिका के माननीय राष्ट्रपति ने दिनांक 20.02.2026 को एक कार्यकारी आदेश जारी कर पारस्परिक शुल्क संबंधी अपने विभिन्न पूर्व कार्यकारी आदेशों को समाप्त कर दिया है।
हालांकि, पारस्परिक शुल्क के अस्थायी विकल्प के रूप में, संयुक्त राज्य अमेरिका के माननीय राष्ट्रपति ने दिनांक 20.02.2026 को एक उद्घोषणा (प्रति संलग्न) जारी की है, जिसके माध्यम से 24.02.2026 से 150 दिनों की अवधि के लिए वैश्विक आयातों पर 10% का अस्थायी एड-वैलोरम आयात अधिभार लगाया गया है। यह आयात अधिभार वर्ष 1974 के ट्रेड एक्ट की धारा 122 के अंतर्गत गंभीर भुगतान संतुलन घाटे एवं नकारात्मक शुद्ध अंतरराष्ट्रीय निवेश स्थिति के समाधान के उद्देश्य से अधिरोपित किया गया है।
पूर्व में, अमेरिकी ‘डी मिनिमिस’ आयात छूट (धारा 321) के अंतर्गत 800 अमेरिकी डॉलर या उससे कम खुदरा मूल्य की वस्तुओं को शुल्क-मुक्त तथा सरल एवं त्वरित सीमा शुल्क निकासी की अनुमति थी। तथापि, दिनांक 30.07.2025 के कार्यकारी आदेश के माध्यम से यह छूट सभी देशों के लिए निलंबित कर दी गई थी। अब दिनांक 20.02.2026 के एक अन्य कार्यकारी आदेश (प्रति संलग्न) द्वारा ‘डी मिनिमिस’ आयात शुल्क छूट के निलंबन को जारी रखा गया है।
उपर्युक्त के परिप्रेक्ष्य में, भारत से संयुक्त राज्य अमेरिका को निर्यातित चर्म, चर्म के उत्पाद एवं पादत्राण दिनांक 24.02.2026 से 10% के पारस्परिक/अस्थायी आयात अधिभार के अधीन होंगे। इसके अतिरिक्त, सामान्य एमएफएन शुल्क (विवरण संलग्न) भी लागू रहेंगे।
