Subject: Request for Inputs on Regulatory & Compliance Regimes and Challenges under Foreign Manufacturers Certification Scheme (FMCS) of BIS-reg

The Council has received a communication from the Department of Commerce, Government of India today seeking inputs on the existing regulatory and compliance regimes governing product certification and market access in major international markets, namely the UK, US, UAE, European Union (EU), Russia, Canada, and New Zealand.

The Department has also sought information on the challenges being faced by Indian exporters under the Foreign Manufacturers Certification Scheme (FMCS) issued by the Bureau of Indian Standards (BIS).

In this regard, member exporters/manufacturers who have obtained, applied for, or are currently dealing with BIS FMCS certification are requested to share their experience and inputs on the following aspects:

1.     Regulatory and conformity assessment frameworks applicable in the above-mentioned countries, including certification, testing, inspection, factory audit, and market surveillance requirements.

2.     Comparative assessment of certification procedures, timelines, costs, and compliance obligations vis-à-vis the BIS FMCS framework.

3.     Specific challenges experienced under FMCS, including but not limited to:
·        Lengthy approval timelines and procedural complexities;
·        Frequency and cost of factory inspections/audits;
·        Testing requirements and laboratory-related issues;
·        Documentation and administrative burdens;
·        Renewal, surveillance, and compliance-related challenges;
·        Impact on export competitiveness and market access.

4.     Suggestions for streamlining FMCS procedures, reducing compliance burden, improving ease of certification, and aligning the scheme with international best practices.

The information received will be consolidated and submitted to the Department of Commerce for consideration. Your valuable inputs will assist the Government in identifying areas for regulatory simplification and facilitating ease of doing business for exporters.

Members are requested to furnish their inputs on or before 12.06.2026 (Friday) to enable timely submission of a consolidated response to the Ministry.

विषय: बीआईएस की विदेशी निर्माता प्रमाणन योजना (एफएमसीएस) के अंतर्गत नियामक और अनुपालन व्यवस्था और चुनौतियों पर जानकारी के लिए अनुरोध

भारत सरकार के वाणिज्य विभाग ने आज परिषद् को एक पत्र भेजा है, जिसमें यूके, यूएस, यूएई, यूरोपीय संघ (ईयू), रूस, कनाडा और न्यूजीलैंड जैसे प्रमुख अंतरराष्ट्रीय बाजारों में उत्पाद प्रमाणन और बाजार पहुंच के नियमों और अनुपालन प्रणालियों पर सुझाव मांगे गए हैं।

विभाग ने भारतीय मानक ब्यूरो (बीआईएस) द्वारा जारी ‘विदेशी निर्माता प्रमाणन योजना’ (एफएमसीएस) के अंतर्गत भारतीय निर्यातकों के सामने आ रही चुनौतियों की जानकारी भी मांगी है।

इस संबंध में, जिन सदस्य निर्यातकों/निर्माताओं ने बीआईएस एफएमसीएस प्रमाणन प्राप्त किया है, आवेदन किया है, या जो अभी इस प्रक्रिया से गुजर रहे हैं, उनसे अनुरोध है कि वे निम्नलिखित पहलुओं पर अपने अनुभव और सुझाव साझा करें:

1.     उपर्युक्त देशों में लागू विनियामक और अनुरूपता मूल्यांकन व्यवस्था, जिसमें प्रमाणन, परीक्षण, निरीक्षण, कारखाना निरीक्षण और बाजार निगरानी की आवश्यकताएं शामिल हैं।

2.     बीआईएस एफएमसीएस व्यवस्था के संदर्भ में प्रमाणन प्रक्रियाओं, समय-सीमाओं, लागतों और अनुपालन दायित्वों का तुलनात्मक विश्लेषण।

3.     एफएमसीएस के अंतर्गत आने वाली विशिष्ट चुनौतियाँ, जिनमें निम्नलिखित शामिल हैं परंतु इन्हीं तक सीमित नहीं:

• लंबी मंजूरी समयसीमा और प्रक्रियात्मक जटिलताएँ;
  कारखाने के निरीक्षण/ऑडिट की आवृत्ति और लागत;
  ·        परीक्षण आवश्यकताएँ और प्रयोगशाला-संबंधी मुद्दे;
  ·        दस्तावेज़ीकरण और प्रशासनिक बोझ;
  ·        नवीनीकरण, निगरानी और अनुपालन-संबंधी चुनौतियाँ;
  ·        निर्यात प्रतिस्पर्धात्मकता और बाजार पहुंच पर प्रभाव।

  4.     एफएमसीएस प्रक्रियाओं को सुव्यवस्थित करने, अनुपालन बोझ को कम करने, प्रमाणन में आसानी में सुधार करने और योजना को अंतर्राष्ट्रीय सर्वोत्तम प्रथाओं के अनुरूप बनाने के लिए सुझाव।

  प्राप्त सूचनाओं को संकलित कर वाणिज्य मंत्रालय को भेजा जाएगा। आपके बहुमूल्य सुझाव सरकार को नियमों को सरल बनाने और निर्यातकों के लिए व्यापार सुगमता बढ़ाने में मदद करेंगे।

  सदस्यों से अनुरोध है कि वे मंत्रालय को समय पर समेकित प्रतिक्रिया प्रस्तुत करने के लिए 12.06.2026 (शुक्रवार) तक या उससे पहले अपने सुझाव प्रदान करें।
