Sub : E-Waste (Management & Handling)
Dear Sir,
The Council has received a communication recently from Department of Commerce informing about the following regulation notified by Ministry of Environment, Forests & Climate change, Government of India.
“The Ministry of Environment, forest & Climate Change has notified the E-Waste (Management & Handling) Rules, 2011 (vide Gazette Notification No.S/O.1125 E dated 14th May, 2010 and No. S.O. 1035 (E) dated 12.5.2011) to ensure that E-Waste (the used Electrical & Electronic Equipments interred for discard) is channelized to registered recyclers or dismantlers for environmentally sound recycling.
As per the provision of said Rules, most of the offices/departments/institutions/industries fall in the category of Bulk Consumers of Electrical & Electronic Equipment (EEE) and have the responsibility of channelizing the E-Waste generated to authorized collection centers or registered dismantlers or recyclers or to the producers through take back services provided by them. Further records of such channelization of E-Waste should be maintained in Form 2 (copy enclosed) and such records should be made available for scrutiny by the State Pollution Control Boards (SPCBs)/Pollution Control Committees (PCCs) concerned whenever they ask for the list of Registered Dismantlers/Recyclers is available at CPCB website www.cpcb.nic.in
It is requested that steps may be taken to ensure that E-Waste generated from offices/ departments/institutions/industries under your Ministry is channelized as specified above to ensure environmentally sound dismantling/recycling of E-Waste. Further, in order to ensure effective implementation of E-Waste (Management & Handling) Rules 2011, departmental purchase of EEE may be restricted to only those Producers which have valid authorization from Pollution Control Boards/Pollution Control Committees”.
