Sub : DGFT Trade Notice on Searchable Database for Ad-hoc norms

Dear Sir,

As you are kindly aware, the inputs allowed for under Advance Authorisation Scheme /DFIA are notified under Standard Input Output Norms (SION).

Advance Authorisation is issued to allow duty free import of input, which is physically incorporated in export product (making normal allowance for wastage). In addition, fuel, oil, catalyst which is consumed / utilized in the process of production of export product, may also be allowed.

Advance Authorisation is issued for inputs in relation to resultant product, on the following basis: (i) As per Standard Input Output Norms (SION) notified (available in Hand Book of Procedures); OR (ii) On the basis of self declaration as per paragraph 4.07 of Handbook of Procedures. OR (iii) Applicant-specific prior fixation of norm by the Norms Committee as per para 4.06 of Handbook of Procedures. OR (iv) On the basis of Self Ratification Scheme in terms of Para 4.06 of Foreign Trade Policy

Kindly find enclosed Trade Notice No.15/2023-24 dated 17.07.23 received from DGFT, New Delhi regarding introduction of a Searchable Database for Ad-hoc norms fixed under Para 4.07 of Handbook of Procedures (HBP) for your kind information and reference.

Para 4.07 of HBP is reproduced below for kind information of members.

4.07 Self-Declared Authorisations where SION does not exist

(i)                  Regional Authority may also issue Advance Authorisation where there is no SION/valid Ad hoc Norms for an export product or where SION / Ad hoc norms have been notified / published but exporter intends to use additional inputs in the manufacturing process, based on self-declaration by applicant. Wastage so claimed shall be subject to wastage norms as decided by Norms Committee. The applicant shall submit an undertaking to abide by decision of Norms Committee. The provisions in this regard are given in paragraph 4.03 and 4.11 of FTP.

(ii)                In case of revision / rejection, applicant shall pay duty and interest as notified by DoR within thirty days from the date of hosting of Norms Committee decision on DGFT website.

The aforesaid Trade Notice states the following.

·        Exporter can search for the adhoc norms by logging to the DGFT website under the icon Services – Advance Authorisation/DFIA- Adhoc Norms

·        If an adhoc norm is found to be suitable in terms of item description, specified wastages, and is valid as per the Handbook of Procedures Provisions, applicants have the option to apply for an Advance Authorisation under the No – Norm Repeat basis. In such cases, ratification by the Norms Committee will not be required, subject to other provisions of the Foreign Trade Policy/ Handbook of Procedures.

The validity of the adhoc norms is as follows

Norms ratified by any Norms Committee (NC) in the O/o DGFT on or after 01.04.2023 in respect of any Advance Authorisation obtained under paragraph 4.07 shall be valid for a period of 3 years from the date of ratification. However, the Norms ratified by any Norms Committee (NC) on or after 01.04.2015 in respect of any Advance Authorisation obtained under paragraph 4.07 of HBP, 2015-2020 shall also be valid further up to 31.03.2026
