2. DGFT Notification No.25/2009-14, dt.15th Jan 2010 Reg. Focus Product & Market Linked Focus Product Scheme

I. We would like to inform the Members that Director General of Foreign Trade has issued a Public Notice No.34/2009-14 dt.15th January 2010 making the following amendments in Appendix 37A, 37C and 37D of the Hand Book of Procedures in the Foreign Trade Policy 2009-14 with effect from 1.1.2010. Appendix 37C gives the List of Notified Markets under the Focus Market Scheme and Appendix 37D gives the List of Notified Products under the Focus Product Scheme, as indicated below.
Appendix 37C

LIST OF NOTIFIED MARKETS UNDER FOCUS MARKET SCHEME (FMS)

	Note 1 : For exports made from the date of announcement of FTP 2009-2014, the exporters may file claims using this Appendix 37C. For exports prior to that, the exporters may file claims using the Appendix 37C as it existed prior to the date of announcement of the FTP 2009-2014.

Vide the subject DGFT Public Notice No.34/2009-14, the following changes have been made :

The Column heading titled ‘Admissible Date of Export’ is replaced as ‘Admissible Date of Export/Period’
In Appendices 37C & 37D, the following is added after the existing note(s). “Note for Admissible Date of Export/Period : The admissible date of export for claiming benefits is 27.8.2009, unless a specific date of export/period is specified by public notice/notifications.”

II.DGFT has also issued a Notification No.25/2009-14, dt.15th Jan 2010 making the following amendments in the Foreign Trade Policy with effect from 1.1.2010. As per existing Policy, the eligibility of exports for Focus Market, Focus Product and MLFPS is as below:

FOCUS MARKET SCHEME (FMS)

3.14.2 Exporters of all products to notified countries (as in Appendix 37C of HBPv1) shall be entitled for Duty Credit Scrip equivalent to 3% of FOB value of exports (in free foreign exchange) for exports made from 27.8.2009 onwards.

FOCUS PRODUCT SCHEME (FPS)

3.15.2 Exports of notified products (as in Appendix 37D of HBPv1) to all countries (including SEZ units) shall be entitled for Duty Credit Scrip equivalent to 2% of FOB value of exports (in free foreign exchange) for exports made from 27.8.2009 onwards.

MARKET LINKED FOCUS PRODUCT SCRIP (MLFPS)

3.15.3 Export of Products/Sectors of high export intensity/employment potential (which are not covered under present FPS List) would be incentivized at 2% of FOB value of exports (in free foreign exchange) under FPS when exported to the Linked Market (countries), which are not covered in the present FMS list, as notified in Appendix 37D of HBPv1, for exports made from 27.8.2009 onwards.

Vide the subject Notification No.25/2009-14, dt.15th Jan 2010 , it has been stated that at the end of the above paras, the word ‘onwards’ is replaced by ‘onwards, unless a specific date of export/period is specified by public notice/notification.’
