Sub:    Certification of Origin of Goods for European Union (EU) GSP – – Self-Certification- Modification of the system as of 1 January 2017 – Issue of DGFT Public Notice

 Dear Sir,

This is in continuation to our earlier circular on Jan. 3, 2017 on the above subject (given below).  DGFT Public Notice No. 51/2015-2020 DATED 30.12.2016 stated the following.

Under the Registered Exporter System (REX) new scheme of self-certification, being introduced from 1.1.2017, the current system of issuance of certificates of origin (Form-A) by competent authorities as listed in Appendix 2C of Foreign Trade Policy (2015-20) will be replaced with “statements on origin” to be issued by exporters themselves. This “statement on origin” is to be made out on, on any commercial document (such as commercial invoice etc.) of the exported consignment. However, during the transition period of twelve months from 1.1.2017 until 31.12.2017, the competent authorities [as listed in Appendix 2C of the FTP (2015-20)] would continue to issue certificates of origin (Form A) at the request of exporters who are not registered in the REX system. At the end of this period, i.e. from 1.1.2018 onwards, the consignments above the value of € 6000 will be entitled to GSP preferential tariff treatment, only if accompanied by a statement on origin made out by a registered exporter. Exporters consigning low value goods (i.e. less than €6000 per consignment) are however entitled to make out statements on origin without being registered in REX, instead of submitting “Form- A” from 1.1.2017 itself.

The DGFT has now issued a Public Notice No. 51/2015-20 dated 9th Jan. 2018 stating that the transition period for exporters to register under REX for availing benefits under EU GSP has been extended from 31.12.2017 to 30.06.2018. After 30.6.2018, benefits under EU-GSP scheme can be availed by those exporters who are registered under REX system and can self-certify the rules of origin on a commercial document (instead of Certificate of Origin issued by the authorised agencies)

As you are kindly aware, we had earlier sent the following information regarding new self certification scheme of EU GSP program.

  • Communication issued by EU Commission self certification scheme
  • Concept note issued by Department of Commerce

The DGFT has now issued a Public Notice No.51(2015-2020) dated 30th Dec 2016 stating the following.

  • Under the Registered Exporter System (REX) new scheme of self-certification, being introduced from 1.1.2017, the current system of issuance of certificates of origin (Form-A) by competent authorities as listed in Appendix 2C of Foreign Trade Policy (2015-20) will be replaced with “statements on origin” to be issued by exporters themselves.   • Under the Registered Exporter System(REX) being introduced from 1.1.2017, exporters with a REX number will be able to self-certify the Statement on Origin of their goods being exported to EU under the GSP scheme.
  • The registration on REX is without any fee or charges and this system would eventually phase out the current system of issuance of Certificates of Origin (Form-A) by the Competent Authorities listed in Appendix-2C of FTP (2015-20) by 1.1.2018 (one year transition period).
  • The aforesaid Public Notices also has the following details.
  1. Details of the new self-certification scheme in Annexure-I to Appendix 2 C to the Public Notice No.51
  1. Application for becoming a registered exporter in REX system in Annexure-1-C
  1. Statement of Origin for self-certification in Annexure-1-D. It is learnt from Export Inspection Agency (EIA), Chennai that if the consignment value is less than Euro 6000, then the exporter can make self declaration in this format in any commercial document (invoice).

Members may hence approach their respective Export Inspection Agency office for more details. For consignments which have a value of more than Euro 6000, such registration in REX system is mandatory. However, till such registration in REX is completed, EIA will continue to issue Certificates of Origin for consignments with value of more than Euro 6000.
