Kindly refer to our earlier circular dated 16th October 2025 on the above subject.
The DGFT has now issued a Public Notice No. 46 dated 5.2.26 (copy enclosed) extending the deadline for filing of annual return for the year 2023-24 till 31.3.26, with a composition fee of Rs.15,000.
As already informed through circulars and through webinars, the following points may be noted.
As per DGFT Public Notice No.27 dated 23rd October 2024 (copy enclosed), exporters availing RODTEP benefit of more than Rs.1 crore a year are required to file annual return for the year 2023-24.
As per Trade Notice No. 27/2024-25 dated 29th January 2025 issued by DGFT read with FAQs (copy enclosed along with FAQs), the following clarifications have been provided.
· If the total RoDTEP claim for a given IEC exceeds Rs. 1 crore in a financial year, filing the Annual RoDTEP Return (ARR) is mandatory. Conversely, if the total claims for a given IEC remain below Rs. 1 crore for the financial year, you need NOT file the ARR
· Once you qualify under the rule above, and yet none of the individual 8-digit ITCHS codes crosses Rs. 50 lakh in RoDTEP claims, you may file the ARR only for the 8 digit code under which you claimed the highest amount. For example, if your total RoDTEP claim in a year amounts to Rs. 1.2 crore— where the distribution is -ITC-HS1: Rs. 20 lakh, -ITC-HS2: Rs. 30 lakh, -ITC-HS3: Rs. 40 lakh, and -ITC-HS4: Rs. 30 lakh, you need to file an ARR only for ITC-HS3, since it represents the highest claim.
· However, after qualifying under the Rs.1 cr rule, if any individual 8-digit ITC-HS code exceeds Rs. 50 lakh in RoDTEP, an ARR must be filed for each of those codes exceeding Rs.50 lakh. For instance, if your total RoDTEP claim is Rs. 1.2 crore, where the distribution is -ITC-HS1 at Rs. 60 lakh, -ITC-HS2 at Rs. 51 lakh, -ITC-HS3 at Rs. 3 lakh, and -ITC-HS4 at Rs 6 lakh, you are required to file ARRs for ITC-HS1 and ITC-HS2, while you may ignore the remaining codes whose claims are below the Rs. 50 lakh threshold.

डीजीएफटी ने अब 5.2.26 को सार्वजनिक सूचना संख्या 46 जारी की है (प्रति संलग्न) जिसमें वर्ष 2023-24 के लिए वार्षिक रिटर्न दाखिल करने की समय सीमा 31.3.26 तक बढ़ा दी गई है, साथ ही 15,000 रुपये का समझौता शुल्क भी निर्धारित किया गया है।
परिपत्रों और वेबिनारों के माध्यम से पहले ही सूचित किए जाने के अनुसार, निम्नलिखित बिंदुओं पर ध्यान दिया जा सकता है।
डीजीएफटी की सार्वजनिक सूचना संख्या 27 दिनांक 23 अक्टूबर 2024 (प्रति संलग्न) के अनुसार, प्रति वर्ष 1 करोड़ रुपये से अधिक के रोड़टेप लाभ का लाभ उठाने वाले निर्यातकों को वर्ष 2023-24 के लिए वार्षिक रिटर्न दाखिल करना आवश्यक है।
डीजीएफटी द्वारा जारी व्यापार सूचना संख्या 27/2024-25 दिनांक 29 जनवरी 2025 और अक्सर पूछे जाने वाले प्रश्नों (अक्सर पूछे जाने वाले प्रश्नों के साथ प्रति संलग्न) के अनुसार, निम्नलिखित स्पष्टीकरण प्रदान किए गए हैं।
· यदि किसी विशेष औद्योगिक निगम (आईइसी) के लिए कुल रोड़टेप दावा एक वित्तीय वर्ष में 1 करोड़ रुपये से अधिक हो जाता है, तो वार्षिक रोड़टेप रिटर्न (एआरआर) दाखिल करना अनिवार्य है। इसके विपरीत, यदि किसी विशेष आईइसी के लिए कुल दावा वित्तीय वर्ष में 1 करोड़ रुपये से कम रहता है, तो आपको एआरआर दाखिल करने की आवश्यकता नहीं है।
· उपरोक्त नियम के अंतर्गत पात्र होने पर, यदि किसी भी 8-अंकीय आईटीसीएचएस कोड के तहत रोड़टेप दावों की राशि 50 लाख रुपये से अधिक नहीं है, तो आप केवल उसी 8-अंकीय कोड के लिए एआरआर दाखिल कर सकते हैं जिसके तहत आपने उच्चतम राशि का दावा किया है। उदाहरण के लिए, यदि किसी वर्ष में आपका कुल रोड़टेप दावा 1.2 करोड़ रुपये है— जहाँ वितरण इस प्रकार है: -आईटीसी-एचएस1: 20 लाख रुपये, -आईटीसी-एचएस2: 30 लाख रुपये, -आईटीसी-एचएस3: 40 लाख रुपये, और -आईटीसी-एचएस4: 30 लाख रुपये, तो आपको केवल आईटीसी-एचएस3 के लिए एआरआर दाखिल करना होगा, क्योंकि यह उच्चतम दावा है।
· हालांकि, 1 करोड़ रुपये के नियम के तहत पात्रता प्राप्त करने के बाद, यदि किसी भी 8-अंकीय आईटीसी-एचएस कोड का रोड़टेप में मूल्य 50 लाख रुपये से अधिक हो जाता है, तो 50 लाख रुपये से अधिक के प्रत्येक कोड के लिए एआरआर दाखिल करना अनिवार्य है। उदाहरण के लिए, यदि आपका कुल रोड़टेप दावा 1.2 करोड़ रुपये है, जिसमें वितरण -आईटीसी-एचएस1 के लिए 60 लाख रुपये, -आईटीसी-एचएस2 के लिए 51 लाख रुपये, -आईटीसी-एचएस3 के लिए 3 लाख रुपये और -आईटीसी-एचएस4 के लिए 6 लाख रुपये है, तो आपको आईटीसी-एचएस1 और आईटीसी-एचएस2 के लिए एआरआर दाखिल करना होगा, जबकि आप शेष उन कोडों को अनदेखा कर सकते हैं जिनके दावे 50 लाख रुपये की सीमा से कम हैं।
