Sub : Compilation of data for revision of All Industry Rates of Duty Drawback for 2018-19 – Request for data from CLE Members

Dear Member,

Kindly refer to our earlier circular dated April 27, 2018 seeking data in connection with Review of All Industry Rates of Duty Drawback. Needless to mention, verifiable and representation data is require to be submitted to the Directorate of Drawback so as to get better drawback rates. As we have received a reminder from the Directorate of Drawback, we would request you to send the data as per the enclosed format.

Preliminary data can be sent through email on or before June 8, 2018. After verifying by the Chartered Accountant the final data along with supporting documents (shipping bills, invoices & bill of entry) for purchase of inputs used in export products may be sent.

Please accord top priority to this exercise.

Sub : Compilation of data for revision of All Industry Rates of Duty Drawback for 2018-19 – Request for data from CLE Members

Dear Member

With regard to the above, please note the following.

a)      The existing All Industry Rates of Duty Drawback (AIR) covers rebate of Customs duties and applicable Central Excise Duty (mainly for fuel as far as leather sector is concerned) on export products.

b)     The existing drawback rates are in force from January 25, 2018 onwards. Prior to the notification of these rates, CLE submitted data and representations seeking enhancement of Drawback rates and cap values, based on which the DBK rates and cap values for several leather, leather products and footwear were increased.

c)      We have now received a communication from the Drawback Directorate seeking DBK cost data for revision of All Industry Rates of Duty Drawback for 2018-19 in the prescribed proforma.

d)     Accordingly, we would request members to provide the cost data in the following proforma for the period October 2017 – March 2018 or for the period April 2017 to March 2018 (for one financial year). The period for which data is provided may be indicated in the Covering Proforma.

–          Covering Proforma

–          Proforma I (A) – wherein the consumption of input materials and incidence of duties against the export of the product concerned is to be given. In this proforma, the incidence of Only Customs Duty and applicable Central Excise Duty (on fuel ) needs to be given. GST and State Levies/Taxes details are not to be given

–          Proforma II – wherein information on the actual cost, including the break-up required for making the export product and sales realization of such export product is to be given.

–          Proforma III- wherein details of captive power used for manufacturing export product is to be given

f)       Initially, the soft copy of the data may be sent by e-mail by May 21, 2018. After verification of data by Shri Raghunathan, the hard copy of the data (duly certified by Chartered Accountant, along with copies of Shipping bill / Bills of entry for imported input, relevant Central Excise invoices etc.,

g)    The Drawback Directorate has also stated that the data provided should pertain to only those manufacturers who are ready to have their records and production processes subjected to inspection by Customs/ Central Excise Department, if required, for the purpose of correctness of the information.

h)     As per directions of the Drawback Directorate, members are requested to ensure that the data given by them are duly certified by the company Chartered Accountant.

i)       Please fill-in these Proforma separately for each export product category i.e., finished leather, leather footwear, footwear components, leather garments, leather goods, gloves, harness & saddlery etc.
