Members may kindly recall that under European Deforestation regulation (EUDR), cattle hides/ leathers under HSN 4101, 4104 and 4107 were included. This means that Indian suppliers were required to provide geo location of plots where cattle was born, reared, slaughtered etc., once the EUDR comes into force.
With regard to the above, CLE had taken-up the request with the Government of India that the proposed EU deforestation regulation should be dropped for leathers under HSN 4101, 4104 and 4107 for India, considering that such leathers are not derived from deforestation and that India is also placed under “Low Risk” category.
We have now received an update from the Indian Embassy in Brussels informing about adoption of the delegated act by EU, thereby removing certain products including cattle hides/ skins/leathers from EUDR. The delegated act states the following.
Hides, skins and leather are derived products from cattle. Considering the differentiation of the leather downstream value chain from the meat value chain, asymmetries in trade flows between meat and hides, and the relatively low economic value of cattle skins and hides compared to meat within the overall cattle production, economic operators in the Union have limited leverage to demand the information necessary to comply with Regulation (EU) 2023/1115 from their suppliers. In addition, the exclusion of downstream leather products from the scope of Regulation (EU) 2023/1115 creates a fragmented and incoherent approach for the leather sector and for operators placing the relevant goods on the Union market and may result in the relocation rather than the elimination of the deforestation risk. For those reasons, HS Codes ‘ex 4101 Raw hides and skins of cattle (fresh, or salted, dried, limed, pickled or otherwise preserved, but not tanned, parchment-dressed or further prepared) whether or not dehaired or split’, ‘ex 4104 Tanned or crust hides and skins of cattle, without hair on, whether or not split, but not further prepared’, and ‘ex 4107 Leather of cattle, further prepared after tanning or crusting, including parchment-dressed leather, without hair on, whether or not split, other than leather of heading 4114’, should be deleted from Annex I to Regulation (EU) 2023/1115
The Delegated Act will now be submitted to the European Parliament and the Council of the EU for scrutiny before entering into force. During this period, the Parliament and the Council may raise objections within the stipulated timeframe. Delegated Acts enable the European Commission to supplement or amend non-essential elements of existing legislation by providing technical details.

विषय : यूरोपीय वनों की कटाई विनियमन
प्रिय सदस्य,
सदस्यगण को विदित होगा कि यूरोपीय वनों की कटाई विनियमन के अंतर्गत एचएसएन 4101, 4104 एवं 4107 के अंतर्गत आने वाले गोवंशीय खाल एवं चर्म को शामिल किया गया था। इसका अर्थ यह था कि ईयूडीआर लागू होने के पश्चात भारतीय आपूर्तिकर्ताओं को उन भू-खंडों का विवरण उपलब्ध कराना आवश्यक होता, जहाँ संबंधित पशुओं का जन्म हुआ, उनका पालन-पोषण किया गया तथा उनका वध किया गया।
उपरोक्त विषय के संबंध में सीएलई ने भारत सरकार के समक्ष यह अनुरोध उठाया था कि भारत के लिए एचएसएन 4101, 4104 एवं 4107 के अंतर्गत आने वाले चर्म को प्रस्तावित यूरोपीय वनों की कटाई विनियमन के दायरे से बाहर रखा जाए, क्योंकि ऐसे चर्म का वनों की कटाई से कोई संबंध नहीं है तथा भारत को भी “निम्न जोखिम” श्रेणी में रखा गया है।
अब हमें ब्रुसेल्स स्थित भारतीय दूतावास से सूचना प्राप्त हुई है कि यूरोपीय संघ द्वारा प्रत्यायोजित अधिनियम को अपनाया गया है, जिसके माध्यम से गोवंशीय खाल/चर्म सहित कुछ उत्पादों को ईयूडीआर के दायरे से बाहर कर दिया गया है।
उक्त प्रत्यायोजित अधिनियम के अनुसार: खाल, चमड़े एवं चर्म, गोवंश से प्राप्त व्युत्पन्न उत्पाद हैं। चूंकि चर्म मूल्य श्रृंखला, मांस मूल्य श्रृंखला से भिन्न है, मांस एवं खाल के व्यापार प्रवाह में असमानता है तथा समग्र गोवंश उत्पादन में मांस की तुलना में खाल एवं चर्म का आर्थिक मूल्य अपेक्षाकृत कम है, इसलिए यूरोपीय संघ के आर्थिक परिचालकों के पास अपने आपूर्तिकर्ताओं से विनियमन (ईयू) 2023/1115 के अनुपालन हेतु आवश्यक जानकारी प्राप्त करने की सीमित क्षमता होती है। इसके अतिरिक्त, चर्म से निर्मित डाउनस्ट्रीम उत्पादों को विनियमन (ईयू) 2023/1115 के दायरे से बाहर रखने से चर्म क्षेत्र एवं यूरोपीय संघ के बाजार में संबंधित वस्तुओं को रखने वाले परिचालकों के लिए एक खंडित एवं असंगत व्यवस्था उत्पन्न होती है तथा इससे वनों की कटाई के जोखिम के उन्मूलन के बजाय उसके स्थानांतरण की संभावना बढ़ सकती है। इन कारणों से निम्नलिखित एचएस कोडों को विनियमन (ईयू) 2023/1115 के परिशिष्ट-I से हटाया जाना चाहिए: एक्स 4101 – गोवंशीय कच्ची खाल एवं चमड़े (ताज़ा, नमकयुक्त, सूखे, चूना-उपचारित, अचारित अथवा अन्य प्रकार से संरक्षित, किन्तु टैन या अन्य प्रकार से संसाधित नहीं), चाहे बाल हटाए गए हों या विभाजित किए गए हों। एक्स 4104 – बाल रहित गोवंशीय टैन अथवा क्रस्ट खाल एवं चर्म, चाहे विभाजित किए गए हों, किन्तु आगे संसाधित नहीं। एक्स 4107 – टैनिंग अथवा क्रस्टिंग के बाद आगे संसाधित गोवंशीय चर्म, जिसमें पार्चमेंट-प्रसंस्कृत चर्म भी शामिल है, बाल रहित, चाहे विभाजित किया गया हो अथवा नहीं, परंतु शीर्षक 4114 के अंतर्गत आने वाले चर्म को छोड़कर।
यह प्रत्यायोजित अधिनियम अब प्रभावी होने से पूर्व परीक्षण हेतु यूरोपीय संसद तथा यूरोपीय संघ परिषद को भेजा जाएगा। इस परीक्षण अवधि के दौरान, संसद एवं परिषद निर्धारित समय-सीमा के भीतर इस पर आपत्ति दर्ज करा सकते हैं। प्रत्यायोजित अधिनियम यूरोपीय आयोग को प्रचलित विधायी प्रावधानों के गैर-मौलिक तत्वों में तकनीकी विवरण जोड़कर अथवा उनमें संशोधन करके संबंधित कानूनों को पूरक एवं अद्यतन करने का अधिकार प्रदान करते हैं।
